Rescuing from Complicity Charges: Defending a P2P Trader in a Bank Fraud Case

Detailed Description

A client working in the cryptocurrency exchange sector (as a P2P trader) approached us. During their professional activities, they conducted a standard USDT-to-fiat exchange transaction. At the time of the transaction, everything looked legitimate: the sender's fiat details (full name, bank account info) completely matched the account details on the Binance crypto exchange, raising no suspicion whatsoever.

However, it turned out that the funds had been stolen from a third party by fraudsters using a complex social engineering scheme (a fake notification about a lost package, coercing the victim to transfer money to a "secure account"). The criminals used the victims' accounts for multiple transfers ("mixing") to cover their tracks, resulting in a portion of these funds landing in our client's account. Consequently, our client's bank accounts were blocked, and they were detained by the law enforcement agencies of Thailand.

The Client's Problem

The client faced serious criminal charges for complicity in fraud and money laundering. At the time of the initial contact, they were under arrest, their assets were frozen, and the situation was classified as a severe felony carrying a high probability of a lengthy prison sentence under Thai law.

What We Did

Our team took the following steps:

  • Comprehensive Evidence Collection: We conducted a detailed analysis of the entire transaction history, gathering chats, negotiation screenshots, and transfer confirmations.

  • Proving Good Faith: We focused on establishing that the client did not know and could not have known about the illicit origin of the funds, as all verification details (KYC) matched.

  • Legal Representation: We compellingly presented the gathered evidence to law enforcement agencies, emphasizing the complete lack of criminal intent or a direct connection to the fraudulent scheme.

Result

Thanks to our defense strategy, the client was cleared of all charges. The entire legal process took about half a year, which is an extremely successful outcome for a case of this category in Thailand, where money laundering charges are treated with utmost severity and carry potential long-term prison sentences. The client was highly satisfied with the result, as we successfully proved their innocence and minimized the negative consequences of the incident.
